CHICAGO ~ Chicago Mayor Reaffirms Commitment to Welcoming City Ordinance Amidst Transition in Federal Administration

In light of the upcoming transition in the federal administration, the City of Chicago and Mayor Brandon Johnson's Administration have reaffirmed their commitment to the Welcoming City Ordinance. This ordinance, which was passed in 2012, aims to protect and support all residents regardless of their immigration status.

To ensure that the city remains in compliance with the Illinois Trust Act, recommended guidelines have been issued to sister agencies. These guidelines provide additional information on how to handle visits by federal representatives.

According to Section 2-173-020(c) of Chapter 2-173 of the Municipal Code of Chicago, these are the recommended guidelines for visits by U.S. Immigration and Customs Enforcement (ICE):

Firstly, agencies or departments are advised to contact their designated attorney or general counsel for further guidance if ICE visits a city property. They should also contact the highest ranking official or designated supervisor on site and refrain from taking any action until that person arrives.

Furthermore, agencies are instructed not to consent to ICE entering any private or "sensitive" city location. In case ICE conducts a search with or without a judicial warrant, they should not interfere with the search. The highest ranking official or designated supervisor should demand identification from ICE officers and make a written record if they refuse.

Moreover, agencies are advised to demand that ICE produce a judicial warrant authorizing them to search the premises and request a copy of it. They should also take notes during the search and ask for a list of any items seized. Any refusal by an officer to comply with these requests should be documented.

In case an administrative warrant seeking Employment Eligibility Verification Forms or Forms I-9 is received, agencies are instructed to seek further guidance from their designated attorney or general counsel.

Similar guidelines apply for visits by other federal representatives who may be seeking to arrest and deport undocumented immigrants. Agencies are advised to follow the same guidance as mentioned above.

For visits by non-federal representatives, agencies are instructed to contact the highest ranking official or designated supervisor on site. If there is criminal behavior or a threat of danger, they should immediately call 911. In other cases, they should seek guidance from their designated attorney or general counsel.

It is important to note that these guidelines are subject to revision and may be updated as needed. However, it is also important to comply with federal law, which states that nothing in this memorandum shall prohibit or restrict any government entity or official from sending or receiving information regarding the citizenship or immigration status of any individual.

In conclusion, the City of Chicago and Mayor Brandon Johnson's Administration are committed to upholding the Welcoming City Ordinance and ensuring that all residents feel safe and supported regardless of their immigration status. These guidelines serve as a reminder of the city's values and commitment to its diverse community.
