Court Denies State’s Motion to Detain Pre-trial a Naperville Man Accused of Shooting Another Man in the Chest

~ In a recent court hearing, DuPage County State's Attorney Robert Berlin and Naperville Chief of Police Jason Arres announced that Judge Joshua Dieden has denied the State's motion to detain Jermaine Badie, an 18-year-old man from Naperville. Badie is accused of shooting another man in the chest and appeared in First Appearance Court this morning.

According to the press release, Badie has been charged with one count of Aggravated Battery – Discharge Machine Gun and one count of Unlawful Possession of a Machine Gun, both of which are Class X Felonies. If found guilty, he could face a sentence of twelve to forty-five years in the Illinois Department of Corrections. As a condition of his pre-trial release, Badie will be subject to GPS electronic monitoring.

The incident occurred on October 28, 2024, at approximately 8:48 p.m., when the Naperville Police Department received a 911 call reporting a possible gunshot victim in the 100 block of Testa Drive. Upon arrival at the scene, officers found the victim lying on his back with blood on his chest and in the surrounding grass. He was immediately taken to a local hospital for medical treatment.

Further investigation into the shooting revealed that Badie and several other individuals were present at the scene when a fight broke out between the victim and another person. It is alleged that after the fight ended, Badie pulled out a black and silver Glock with a thirty-round extended magazine and shot the victim in the chest. The firearm also had attachments for a silencer and switch to convert it into a fully automatic weapon. After firing the shot, Badie fled from the scene but was later apprehended by Naperville police officers.

According to authorities, the bullet fired by Badie entered through the victim's chest, narrowly missing his heart before exiting through his back and striking his lung. State's Attorney Berlin expressed outrage at the allegations, stating that violent crimes committed with firearms will not be tolerated in DuPage County. He also commended the Naperville Police Department for their swift actions in identifying and apprehending Badie.

Chief Arres also praised the efforts of his officers and investigators, as well as the partnership with State's Attorney Berlin's office. Badie's next court appearance is scheduled for November 25, 2024, for arraignment in front of Judge Ann Celine O'Hallaren Walsh.

The public is reminded that the charges against Badie are only allegations and he is presumed innocent until proven guilty in a court of law. It is the government's burden to prove his guilt beyond a reasonable doubt.
