Naperville: Court Grants State’s Motion to Detain Pre-Trial Cicero Man Accused of Pointing Gun at Motorist/Fleeing from Police

~ In a recent court hearing, DuPage County State's Attorney Robert Berlin and Naperville Chief of Police Jason Arres announced that Judge Robert Rohm has granted the State's motion to deny pre-trial release for Jose Gutierrez, a 31-year-old man from Cicero. Gutierrez is accused of fleeing from police after allegedly pointing a gun at another motorist in a road rage incident.

According to the press release, on the evening of August 8, 2025, Naperville police officers responded to a call about a road rage incident near Naper Boulevard and Plank Road. The individual involved was later identified as Gutierrez. It is alleged that Gutierrez pointed a handgun at another driver during the incident.

At approximately 8:49 p.m., a Naperville police officer located Gutierrez and conducted a traffic stop. Initially, Gutierrez complied with the officer's commands by stopping and placing his hands outside the driver's side window. However, he then fled the scene instead of remaining stopped.

Naperville police officers followed Gutierrez and deployed a stop-stick while he was stopped at a red light on Naper Boulevard. Despite running over the stop-stick, it is alleged that Gutierrez continued to flee at high speeds on I-88, weaving in and out of traffic and reaching speeds over 95 mph.

The pursuit continued onto I-355, Finley Road, and Roosevelt Road where another stop-stick was deployed. Despite driving on his rims, Gutierrez allegedly continued to flee eastbound on Roosevelt Road before swerving into westbound lanes at speeds over 90 mph. He eventually came to a stop in the far left lane before fleeing on foot into westbound traffic.

After a foot chase, Gutierrez was apprehended by officers. A loaded Pheonix Arms .22 caliber handgun with one round in the chamber was found near the initial stop location where it is alleged that Gutierrez had thrown it out of the vehicle. A search of the vehicle also revealed .22 caliber ammunition.

State's Attorney Berlin expressed outrage at the allegations against Gutierrez, stating that his actions were not only reckless but also put the lives of others, including the officers involved, at risk. He reminded motorists to pull over when they see emergency lights and sirens and not to attempt to outrun the police.

Chief Arres also condemned Gutierrez's alleged behavior, stating that their swift response with assistance from neighboring agencies helped apprehend the suspect and recover the weapon before anyone was hurt. He thanked State's Attorney Berlin and his team for their support in holding dangerous offenders accountable.

Gutierrez appeared in First Appearance Court this morning where he was charged with two counts of Aggravated Fleeing and Eluding a Police Officer, one count of Aggravated Unlawful Possession of a Weapon, and multiple misdemeanor offenses including Aggravated Assault, Resisting a Police Officer, Reckless Driving, and Transportation of Open Alcohol by a Driver.

His next court appearance is scheduled for August 11, 2025, in front of Judge Mia McPherson. The public is reminded that these charges are only allegations and Gutierrez is presumed innocent until proven guilty in a court of law.
